Is CBD Legal in All 50 States?

The short answer: Yes, CBD is legal, but under specific conditions.

While the legal status of CBD has become more defined with recent reforms, some laws are still unclear and others may still be needed. Combined with misinformation, many may have a very skewed understanding of what’s legal versus what isn’t.

Is CBD illegal in any state? It depends unless you're referring to CBD with THC levels over .3% then yes it is illegal in some states.  If the amount of CBD is less than .3% and sourced from Hemp extract then it is legal in all 50 plants.  Luckily if you are reading this then you can be rest assured that all the CBD on our site has no THC in it and you can buy it today worry free!

As of today, CBD with amounts of THC over .3% or CBD sourced from marijuana plants is legal for sale and consumption n these 10 states – California, Washington, Colorado, Nevada, Maine, Massachusetts, Michigan, Alaska, Oregon, Vermont and District of Columbia.

The legality of CBD can vary from state to state and federally, but in general, one of the determining factors is whether the CBD is derived from hemp or marijuana.

While the two plants are very close relatives, they are classified very differently under the law and understanding the difference is crucial to legally use CBD.

2018 HEMP FARMING ACT

Up until now the legality of hemp on a Federal level has been fairly ambiguous. The Hemp Farming Act of 2018 aims to change this. Introduced on April 12, 2018, by Mitch McConnell and co-sponsored by Oregon Senators Ron Wyden and Jeff Merkley, this act would finally remove hemp from the Federal list of Schedule 1 Controlled Substances. This would not only clear the legal air around hemp farming in general–it would also open the doors for hemp farmers to receive more federal aid in the form of water rights and agricultural grants.

Of course, having hemp categorized as a Schedule 1 Controlled Substance (the same as heroin) to begin with is pretty ridiculous. While it is possible for a completely negligible amount of THC to make its way from a hemp plant to CBD Oil during the CBD extraction process, we make sure there is zero chance of this happening with our on-site chromatography testing and 3rd party batch testing. Thanks to the passing of the Hemp Farming bill our CBD is and always will be legal in all 50 states while this bill remains intact.
