CBD Oil & Hemp Extract – Is It All Legal?
As we all know, the sale and distribution of medical marijuana is not legal in many states but, because of this, it has left many people wondering if it is legal to buy CBD or hemp oil in their state. If you have also wondered this, don’t worry – you are not alone! The laws regarding CBD and hemp oil sale have been vague in the past and have confused even industry insiders about the legality of cross-state sales. While it is legal in every state in the US, there are some states in which certain CBD may not technically be legal due to the amount of THC in the CBD extract. The difference between CBD vs THC is another subject we will get to later in this discussion.
How the 2018 Farm Bill Impacts the Sale of CBD and Hemp Oil
Recently, there was a new bill passed regarding the legality of CBD and hemp oil. Consumer Reports explains the implications of the new bill for the CBD and hemp oil market, “A sweeping agriculture bill recently signed by President Trump gives the legislative nod needed to make CBD (cannabidiol), one of hemp’s byproducts, legal at the federal level…The full 2018 Farm Bill is a package of programs estimated to cost $876 billion over 10 years. It touches almost every aspect of farming, food, and food production in the U.S…The bill allows each state to decide whether it wants to okay the sale of CBD products from hemp within its borders. And by changing how marijuana is defined in the Controlled Substances Act so that it doesn’t include hemp, the bill effectively removes CBD derived from hemp from the DEA’s list of controlled substances. Marijuana and hemp are variations of the Cannabis sativa L. plant.”
CBD vs THC
Make no mistake, the passing of the 2018 Farm Bill is a huge win for the CBD and hemp oil community, including businesses and patients. But, before you throw your hats in the air in celebration, it is important to clarify exactly what the passing of the 2018 Farm Bill means for CBD and hemp oil sale and use. Unfortunately, whether CBD and hemp oil is legal depends on who you ask, the state government or the federal government, as Psychology Today points out, “With increasing legalization of cannabis and cannabinoids, more and more states have legalized cannabis and its constituents including THC and CBD for either medical or recreational use (several states have specifically legalized CBD products, but not THC or cannabis in general). But the federal government has held firm, keeping marijuana illegal as a Schedule I drug (defined as having no accepted medical use in the US, a lack of accepted safety for use under medical supervision, and a high potential for abuse) per the Drug Enforcement Agency’s classification of controlled substances…Now, with the passing of the new 2018 Farm Bill, hemp and hemp-derived products have been officially removed from the purview of the Controlled Substances Act, such that they are no longer subject to Schedule I status. Meaning that so long as CBD is extracted from hemp and completely pure (without any THC— something the DEA doubts is possible) and grown by licensed farmers in accordance with state and federal regulations, it is legal as a hemp product.” The CBD vs THC debate basically boils down to the misconception of the public mindset that thinks CBD is only beneficial if there is enough THC present in the product. In actuality the effectiveness of CBD has nothing to do with THC and has all to do with the amount of phytocannabinoids extracted from the hemp plant. Basically as long as your CBD product has less than .03% of THC then that product is legal for use anywhere in the United States and in most foreign countries. Lucky for you Mix Rx has made sure there are no guessing games in regards to THC since they guarantee there isn’t a trace amount of THC present in any of its products.
